Cancellation Proceedings

Cancellation proceedings are initiated by a cancellation application, which may lead to the removal of a trademark from the register. For cancellation, the mark must lack registrability or be subject to absolute protection obstacles. Additionally, cancellation can be pursued through litigation—for instance, due to pre-existing older rights or lack of maintained use. In such cases, the trademark owner has the opportunity to demonstrate proper use and oppose the cancellation application.
