License Analogy

License analogy refers to a method for determining damages when a protected trademark is used abusively or without authorization. The trademark owner may claim damages, often calculated based on the hypothetical fee that the infringer would have paid if they had lawfully used the mark under a licensing agreement—the fictitious value of a standard license.
