Warning Letter

A warning letter is an extrajudicial legal remedy that enables the trademark owner to object to a third party’s infringement of their trademark rights. It notifies the recipient that the use of a similar or identical mark constitutes a violation of exclusive rights and simultaneously requires the infringer to provide a cease and desist declaration. Furthermore, the warning letter often serves as the basis for claiming damages arising from the trademark infringement.
